We hand make our products at our Kent Town workshop to the highest commercial standards using products intended to last 100 years or more. We pay for the best quality materials and therefore rely on the suppliers of our materials to provide a base for our craftspeople to build our products for you. We have been in business for over 85 years and so when we say we give a lifetime guarantee on products we actually can stand by that.

There will be variations in materials and finishes, but they will be minor and fall within our definition of Atkins quality. We will happily address any quality concerns you may have, please raise any issues as soon as you receive and inspect what we have made for you. If you have any doubts reach out. However, we cannot be responsible for poor handling or storage of our products. Please see further details below under our returns policy.

Atkins Photo Lab’s Terms and Conditions

Terms and Conditions

When placing an order with Atkins Photo Lab the client accepts these terms and conditions. These terms and conditions are a part of every contract made between Atkins Photo Lab for the provision of goods and services to any individual or company deemed ‘the client’ for the purpose of this document. These terms and conditions prevail over any written terms and conditions of the client. Any variation to the Terms must be agreed to in writing by a Director of Atkins Photo Lab.

Hours of Operation

Atkins Photo Lab’s operating hours are as follows:
Open in person Monday to Thursday 9am to 4pm. Calls & Emails until 5pm.

Payment and Credit

(i) All orders placed with Atkins Photo Lab, by non-credit account clients, are to be pre paid.

(ii) Atkins Photo Lab reserves the right to charge a deposit of any job value, prior to job commencement.

Methods of Payment

Atkins Photo Lab accepts – Eftpos, Cheques, Direct deposit, MasterCard and Visa.

Application for credit account

If the client requires an account, a credit account application form must be completed and submitted for assessment prior to the facility becoming available. No order can be placed on account terms unless the account is approved and activated.

Credit account clients

Atkins Photo Lab reserves the right to alter or suspend credit terms, cancel orders, or withhold the supply of goods when, in its opinion, the financial circumstances of the client or the status of the clients account requires it. Title to the goods as detailed in each invoice does not pass until payment is received in full.

Quotes

A quotation price will override list pricing provided the order is submitted wholly within the quotation time limit (default is 3 months) and the quotation matches the order. Any variation is at Atkins Photo Lab’s discretion.

Discounts

Discounts are not cumulative and may be revoked if payment terms are not met.

GST

10% GST will be included in all invoices as required by Australian law.

Colour correction

Colour correction is a subjective subject, Atkins Photo Lab’s staff are trained in recognising colour deficiencies and making adjustment to bring images to an accepted standard. Every effort must be made by the client to communicate any colour preferences that the client might have. Colour correcting is not a colour matching service. Colour matching will incur a surcharge on both the colour correction plus print cost. It is impossible to get a 100% match between two images, Atkins Photo Lab will get a reasonable match between prints within the limits of what is possible.

Colour management

Colour management – Atkins Photo Lab’s services are ICC compliant. Digital images supplied for printing must have an embedded ICC profile. Any image supplied without an ICC profile will be assumed to exist in an AdobeRGB colour space. All printing devices have a limited colour gamut, as a part of Atkins Photo Lab’s ICC compliance, we will choose a suitable rendering intent to best translate the clients’ out of gamut colours to the printers gamut, this will result in colours changing, and Atkins Photo Lab’s priority will be a photographic continuous tone representation of the image and not an individual colour’s accuracy.

Print sizing

All prints are borderless and print sizes specified are approximate and are listed in imperial and metric, sizes are rounded and can vary upwards of 5mm from described. Where there are no specific instructions cropping will be at Atkins Photo Labs discretion or full frame will be printed. Prints requiring mounting will require an additional 5mm on all sides greater than the substrate size required.

Service Times

Atkins Photo Lab will use its best endeavours to ensure that orders are completed within the advertised service times but will not accept liability for damages or allow cancellation in the event of failure so to do. All service times are based on receipt of material from the client, which are clearly and correctly presented with all working elements required to produce the job. Service times shorter than advertised may be possible, and if required, may incur a surcharge to pay for penalty rate wages.

Liability

Every care is taken by Atkins Photo Lab to safeguard material left by the customer for processing. In the event of any loss or damage to that material in any way whatsoever and for any reason whatsoever (including negligence of Atkins Photo Lab or breach of copyright) whilst in the custody of Atkins Photo Lab its agents or subcontractors or whilst in transit back to the customer, such claim must be made within ten days of receipt and Atkins Photo Lab’s liability shall not exceed Atkins Photo Lab’s charge for processing the relevant service provided that this limitation of liability does not affect the other rights and remedies in respect of the service or product which the customer has under the Trade Practices Act 1974. There is no guarantee in respect of colour variation in the processed film or prints. All special instructions to Atkins Photo Lab will not be binding on Atkins Photo Lab unless confirmed in writing in a clear and precise manner.

Copyright

By placing an order with Atkins Photo Lab, the client declares their right to reproduce all material supplied. The client assumes absolute liability for any resulting violation of copyright in any action brought by a third party. The client undertakes that they will keep confidential and not use any ideas communicated by Atkins Photo Lab and its representatives without Atkins Photo Lab’s written consent.

Storage of Uncollected Goods

Atkins Photo Lab will not be responsible for storing any material, digital file or other media when the order has been completed. Any goods of the client that have not been collected within six months of completion of the work will be disposed of. Atkins Photo Lab will not accept any liability for any loss or damage sustained by the client as a result of this disposal. While Atkins Photo Lab will make efforts to contact a client regarding uncollected goods, Atkins Photo Lab is under no obligation to succeed in informing the client prior to or after the disposal.

Change to Terms and Conditions

Atkins Photo Lab may vary these terms and conditions at any time without giving notice.

Atkins Photo Lab’s Dispatch and Deliveries Policy

Atkins Photo Lab will use its best endeavours to ensure that orders are completed within the advertised service times but will not accept liability for damages or allow cancellation in the event of failure so to do.

All service times are based on receipt of material from the client, which are clearly and correctly presented with all working elements required to produce the job, and are calculated starting on the day after all of the materials are received. Services times are based on working days, Monday to Friday. The final day of the advertised service time is when the product is ready to be shipped, and shipped if finished before 12 noon that day.

Service times shorter than advertised may be possible, and if required, may incur a surcharge (rush rates) to pay for penalty rate wages.

Atkins clients have a choice of shipping options, from standard untracked to tracked express. Atkins are not responsible for freight providers’ delivery times or reliability, it is the client’s responsibility to insure against any loss or damage to goods in transit to or from Atkins Photo Lab. Freight costs will be charged to the client at commercial rates which will include a packaging fee.

Atkins Photo Lab’s Privacy Policy

The company (Wm.G.Atkins Pty Ltd, trading as Atkins Photo Lab) respects the privacy of it customers. The personal information The Company collects is used for the purpose of processing your work in accordance with your instructions. The personal information The Company collects may include your name, address, phone number, email address, Credit Card details (where you provide them) and any further information you volunteer to us, where necessary, to fulfil your work requirements.

Please be assured we will not disclose any personal information for any other purpose without your consent, except where the use of disclosure is required or authorised by or under law. The Company takes reasonable steps to protect any personal information it holds under law. The Company takes reasonable steps to protect any personal information it holds from misuse, loss, unauthorised access, modification or disclosure.

The Company does not send unsolicited mail, nor does it sell, in whole or part, the personal information it collects and does not disclose it to other organisations, except as provided above. The consequence of you not providing any information requested by The Company is that The Company may not be able to complete your work in accordance with your instructions, nor will it be able to contact you to advise of any issues with the work we are performing for you.

On request you are welcome to view the personal information that we hold about you. If you think that any personal information we hold about you is inaccurate, please contact us as below, and following authentication, we will take reasonable steps to ensure that is corrected.

Atkins Photo Lab’s Returns Policy

Atkins Photo Lab strives to provide high quality services, if the client is dissatisfied with service or products, returns must be made within 10 days of picking up the work. Atkins Photo Lab will entertain all returns submitted in this time frame and evaluate on a case by case basis. Atkins Photo Lab does not offer refunds in cases of change of mind, cheaper price found elsewhere or decided you no longer want it. If there is a mistake made in the production of the item, provided we have been notified within 10 days of picking up the work, we will replace the item with the correct item. A credit may be given to the client if this is unsatisfactory to all parties and providing we have been given every opportunity to satisfy the client’s reasonable requests within a reasonable time frame.
